1. Policy Overview

Midline respects the intellectual property rights of others and expects users and affiliates to do the same. In compliance with the DMCA, we will respond promptly to notices of alleged copyright infringement submitted in accordance with the requirements of this policy.

 

2. Filing a Notice of Claimed Infringement

If you believe your copyrighted work has been used in a way that constitutes infringement, please submit a written notification that includes all of the following information:

  1. A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing, including its location on our website (URL).
  4. Contact information of the complaining party (name, address, telephone number, and email address).
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.

DMCA notices that fail to comply with these requirements may be deemed invalid.

 

3. Counter Notification

If you believe your material has been removed or disabled as a result of mistake or misidentification, you may submit a counter-notification including:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled due to mistake or misidentification.
  4. Your name, address, and telephone number, and a statement consenting to the jurisdiction of Gillespie County, Texas, and that you will accept service of process from the party that filed the initial DMCA notification or an agent thereof.

Upon receipt of a valid counter-notification, we will provide the original complaining party with a copy and inform them that we will replace the removed material or restore access within 10–14 business days unless the copyright owner files an action seeking a court order to restrain the alleged infringement.

 

4. Repeat Infringers

In compliance with the DMCA, we will terminate, when appropriate, user access or accounts of repeat infringers. Midline maintains discretion to disable accounts or remove content that violates copyright laws or company policy.

 

5. Misrepresentations and Penalties

Any person who knowingly misrepresents that material or activity is infringing (or was removed by mistake) shall be liable for damages, including costs and attorney’s fees, under 17 U.S.C. §512(f) and Texas Penal Code §37.10 for false statements. Submitting false or malicious notices is a violation of federal and Texas law.

 

6. Designated Agent Record

Midline maintains its official DMCA Agent record on file in compliance with U.S. Copyright Office regulations. This agent may be contacted exclusively for DMCA-related claims and not for general support inquiries.

 

7. External Service Providers

Midline’s web hosting and data management providers are bound by service-level agreements that comply with the DMCA and applicable Texas laws. Notices sent to external providers must also comply with this policy.

 

8. Modifications

Midline reserves the right to modify this DMCA Notice at any time. Updates will be reflected by the revised effective date above.
